Yayden’s Reservation of Rights

To the full extent permitted by law, Yayden reserves its intellectual property rights in the word or term “Yayden” (and inflections and other variations thereof) and all graphics, logos, designs, page headers, button icons, scripts, look and feel, know how, inventions, creative or artistic works, and all other things (whether tangible or intangible) associated with the Services. You agree that nothing in the Terms (including all of the terms, conditions, policies, and agreements referenced herein and therein) assigns or otherwise conveys any ownership interest any of Yayden’s intellectual property to you. You agree that nothing in the Terms (including all of the terms, conditions, policies, and agreements referenced herein and therein) grants you a license or other permission to use any of Yayden’s intellectual property outside of your use of the Services. You agree that even when using the Services, you will not misappropriate any of Yayden’s intellectual property and that you will not use any of Yayden’s intellectual property in any way that will or likely will cause any injury or damage to Yayden.


You agree that no assignment or other conveyance from Yayden to you of any ownership interest in any of Yayden’s intellectual property will be effective unless it is made by a separate written agreement that is signed by you and Yayden. You agree that no license or other permission from Yayden to you for use any of Yayden’s intellectual property outside of your use of the Services will be effective unless it is made by a separate written agreement that is signed by you and Yayden.


Although applicable law may permit you to make fair use of the word or term “Yayden” (and inflections and other variations thereof) or some other of Yayden’s intellectual property for legitimate commentary or discussions about us or the Services or about your use of the Services, you agree that nothing in the Terms (including all of the terms, conditions, policies, and agreements referenced herein and therein) waives any of Yayden’s rights to take action against you regarding any unlawful use of any of Yayden’s intellectual property and that any such a waiver will not be effective unless it is made by a separate written agreement that is signed by you and Yayden.

Notices of Intellectual Property Infringement

When we receive proper notice of alleged intellectual property infringement, we may remove or disable access to the allegedly infringing material. When we remove or disables access in response to a notice, we may, at our discretion, attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. We may also provide a copy of the notice to the allegedly infringing party.

Counter Notification

If we receive a Digital Millennium Copyright Act counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs us of this action. We will send a copy of the counter notice to the original complaining party.

Repeat Infringement

Yayden may, at our discretion, terminate account privileges of members that are subject to repeat notices of intellectual property infringement.
